Terms & Conditions
Last updated: October 22, 2026
Quick Summary
These Terms & Conditions ("Terms") govern your access to and use of the VoIP Air website, services, and cloud communication products (collectively, the "Services"). By using our website or signing up for our Services, you agree to these Terms. If you do not agree, you may not access or use the Services.
1. Acceptance of Terms
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that entity.
2. Description of Services
VoIP Air provides cloud-based business voice-over-IP (VoIP) telephone services, including but not limited to HD voice calling, auto-attendants, call routing, voicemail-to-email, digital faxing, softphone and mobile applications, pre-configured desk phones, and enterprise IP integrations. Specific features, pricing, and service levels are set forth in your signed service agreement, quote, or order confirmation (the "Order").
In the event of any conflict between these Terms and an Order, the terms of the Order shall control for the services it specifically describes.
3. Accounts & Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract to use the Services. You agree to provide accurate and complete information when requesting a quote or signing up, and to keep your account information current. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity under your account.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable federal, state, or local law or regulation;
- Transmit any material that is unlawful, harassing, defamatory, fraudulent, or infringing on the rights of others;
- Send unsolicited marketing or promotional messages in violation of the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or similar laws;
- Attempt to gain unauthorized access to, disrupt, or damage our systems, networks, or the systems of third parties;
- Resell, sublicense, or resell our Services without written authorization; or
- Use the Services in any manner that could damage, disable, or impair the Services or interfere with another user's use.
VoIP Air reserves the right to suspend or terminate access for violations of these acceptable-use guidelines.
5. Pricing, Billing & Payment
Current pricing for our standard plans is published on our Pricing page and in your Order. Unless otherwise agreed in writing, all recurring fees are billed monthly in advance. First-month promotional offers (such as a reduced first month) apply only with an approved bill submission and a signed contract as described in your quote.
- Taxes & fees: Applicable federal, state, and local taxes and regulatory surcharges are additional unless stated otherwise.
- Late payment: Invoices not paid within thirty (30) days of the invoice date may be subject to a late fee of 1.5% per month or the maximum permitted by law, whichever is less.
- No long-term lock-in: Unless your Order specifies a multi-month term, our standard plans are month-to-month and may be cancelled as described below.
6. Quotes & Savings Analysis
Savings figures shown in our online calculator or in a quote are estimates based on the information you provide. Final pricing and savings depend on the contents of the phone bill you submit, your chosen features, number of lines, and applicable terms agreed in your signed contract. We do not guarantee any specific savings amount unless stated in your signed Order.
7. Service Level & Availability
We strive to maintain a 99.99% uptime for our core voice platform. The Services depend in part on factors outside our control, including your internet service, customer-premises equipment, and underlying carrier networks. We are not responsible for outages or quality issues caused by your internet connection or third-party networks. Any service-level credits are governed by the terms of your signed Order.
8. Cancellation & Termination
You may cancel month-to-month Services by providing written notice (email to support@voipair.com) at least thirty (30) days before your next billing date. If your Order specifies a fixed term, early cancellation may be subject to the fees described in that Order.
VoIP Air may suspend or terminate the Services immediately if you breach these Terms, fail to pay undisputed invoices, or if required to comply with law. Upon termination, all outstanding charges become immediately due and payable.
9. Intellectual Property
All content, software, trademarks, logos, and branding on this website and in the Services are the property of VoIP Air or its licensors and are protected by applicable intellectual-property laws. Nothing in these Terms grants you any right or license to use the VoIP Air name, marks, or proprietary technology except as necessary to use the Services as offered.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, VOIP AIR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VOIP AIR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES. VOIP AIR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID TO VOIP AIR IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. For additional limitations specific to carrier liability, E911 emergency calling, and internet and power dependencies, see our Carrier Liability Disclaimer.
12. Indemnification
You agree to indemnify and hold harmless VoIP Air and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your breach of these Terms, or your violation of applicable law or the rights of a third party.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict-of-law principles, and the applicable laws of the United States. You and VoIP Air submit to the exclusive jurisdiction and venue of the state and federal courts located in St. Tammany Parish, Louisiana, for any dispute arising out of or relating to these Terms or the Services.
The parties shall first attempt to resolve any dispute informally. If informal resolution is not reached within thirty (30) days, either party may pursue its available legal remedies in the courts described above.
14. SMS & Telephone Communications
By providing your phone number and consenting on our forms, you authorize VoIP Air to contact you by SMS or telephone call regarding your inquiry, quote, or account, using an automatic dialing system or prerecorded voice. Message and data rates may apply. You may opt out at any time by replying STOP or by contacting us. See our Privacy Policy for full details.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Material changes to an active paid service will be communicated to you in advance. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
