Carrier Liability Disclaimer
Last updated: October 22, 2026
Quick Summary
VoIP Air provides cloud-based VoIP telephone service, which differs from traditional phone service in important ways. This disclaimer explains the limitations of VoIP technology, including E911 emergency calling, internet and power dependencies, and the responsibilities of VoIP Air versus third-party carriers and service providers. By using our Services, you acknowledge these limitations.
This Carrier Liability Disclaimer supplements our Terms & Conditions and Privacy Policy. Capitalized terms used but not defined here have the meanings given in the Terms. In the event of a conflict, the Terms control except where this disclaimer addresses a specific carrier-liability or E911 matter.
Not a Traditional Telephone Service
VoIP Air provides cloud-based Voice-over-Internet-Protocol (VoIP) telephone service, not traditional wireline telephone service. VoIP services have technical and operational differences from circuit-switched telephone service and may not offer the same level of reliability, quality, or features.
E911 Emergency Calling Limitations
E911 emergency calling over VoIP may not function identically to traditional 911 service. Your registered service address may not automatically transmit to the emergency operator, and call-back capability may be limited if your address is not current or your line is not properly registered. You are responsible for keeping your E911 registered address accurate at all times.
Internet Connection Dependency
VoIP service requires a functioning broadband internet connection and adequate bandwidth. Quality of service, including call clarity and reliability, depends on your internet service provider (ISP), network conditions, and local equipment. VoIP Air is not responsible for service degradation or interruption caused by your internet connection.
Power Outage Dependency
Unlike traditional telephone service, which may continue to function during a power outage, VoIP service requires electrical power at your premises to operate the phones, routers, and network equipment. During a power failure, you may be unable to make or receive calls, including emergency 911 calls.
1. Nature of VoIP Service
VoIP Air delivers voice communication over the internet using Voice-over-Internet-Protocol technology rather than traditional circuit-switched telephone lines. Because VoIP calls are transmitted as data packets over the public internet and private IP networks, the quality, reliability, and availability of the Services depend on factors outside of VoIP Air's control, including your internet connection, your ISP, third-party carriers, and the public internet infrastructure.
2. E911 & Emergency Calling
You acknowledge and agree that E911 or 911 emergency calling over VoIP Air may differ from traditional 911 service, including but not limited to:
- Your registered service address may not automatically be transmitted to the Public Safety Answering Point (PSAP) or may be transmitted as a default dispatch address;
- If you move your VoIP equipment to a new physical location without updating your registered address, emergency calls may route to the wrong PSAP or dispatch location;
- If your internet connection, power, or network equipment is unavailable, you may be unable to reach 911 or other emergency services at all;
- Some PSAPs may not accept text or data communications, limiting how emergency information is delivered;
- Call-back from an emergency operator may fail if the PSAP does not receive a valid call-back number or if the number is not properly registered.
You are responsible for ensuring your E911 registered address is accurate and current at all times. Do not rely on VoIP Air service as your sole means of reaching emergency services.
3. Internet & Power Dependency
The Services require a continuous, stable broadband internet connection and electrical power at your premises. VoIP Air is not responsible for any interruption, degradation, or failure of the Services caused by:
- Power outages, surges, or electrical failures at your location;
- Internet service interruptions, outages, or bandwidth limitations from your ISP;
- Failures of customer-premises equipment, including routers, switches, access points, and IP desk phones;
- Network congestion, packet loss, latency, or jitter on your internet connection or the public internet; or
- Maintenance, upgrades, or configuration changes to your local network.
4. Third-Party Carriers & Networks
VoIP Air routes calls over third-party telecommunications carriers, internet service providers, and underlying network operators. VoIP Air does not own or control these third-party networks and is not responsible for their performance, availability, or actions. Any service-level commitment applies only to the VoIP Air core platform and not to third-party networks, carriers, or the public internet.
VoIP Air may modify its underlying carriers, network partners, or routing paths at any time without notice. Such changes may affect call quality, routing, or features, and VoIP Air shall not be liable for any resulting disruption.
5. Service Availability & No Warranty
While VoIP Air strives to maintain a high level of uptime for its core voice platform, the Services are provided "as is" and "as available." VoIP Air does not guarantee that the Services will be uninterrupted, error-free, secure, or free from delays, or that any call will be completed, connected, or delivered without loss, drop, or quality degradation. To the fullest extent permitted by law, VoIP Air disclaims all warranties, express or implied, relating to the Services, including merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the fullest extent permitted by law, neither VoIP Air nor any of its underlying carriers, network partners, or affiliates shall be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business opportunity arising out of or relating to the unavailability, interruption, delay, or quality of the Services — including, without limitation, any inability to reach emergency services (911), any error or delay in the transmission of E911 location information, or any call that is dropped, misdirected, or not completed.
This limitation applies even if VoIP Air has been advised of the possibility of such damages. Your sole and exclusive remedy for any service issue is as set forth in your signed Order and the Terms & Conditions.
7. Indemnification
You agree to indemnify, defend, and hold harmless VoIP Air and its affiliates from any claim, demand, or damage — including reasonable attorneys' fees — arising from your failure to maintain an accurate E911 registered address, your use of the Services in a manner inconsistent with this disclaimer, or any claim by a third party related to a call placed or received over the Services.
8. Governing Law
This disclaimer is governed by and construed in accordance with the laws of the State of Louisiana and applicable United States federal law, without regard to conflict-of-law principles. Venue for any dispute shall be in the state and federal courts located in St. Tammany Parish, Louisiana. See our Terms & Conditions for the full governing-law and dispute-resolution provisions.
9. Your Acknowledgment
By signing a service agreement, placing an Order, or using the VoIP Air Services, you acknowledge that you have read and understood this Carrier Liability Disclaimer, including the limitations of E911 emergency calling, the dependency on internet and power, and the disclaimers of liability set forth above.
